Areas of Practice

Automobile Accidents

In this country, over 60 car accidents take place per minute. Last year the State of Illinois reported almost 1000 fatalities from car accidents on public roadways. Car accidents happen even when we least expect them. Most of us will be involved in an accident at some time or another in our life. Despite the frequency of these accidents, many people are not aware of their rights and the compensation they can get for their injuries.

If you have been injured in a car accident, take the following steps:

• Record the names of witnesses
• Visit your doctor or go to the emergency room at a hospital or clinic the same day of the accident
• Do not make any statements admitting fault
• Report the accident to the police
• Take a photo of the site of the accident and the vehicles involved
• Call us immediately

When you are injured in a car accident you are entitled to the following benefits:
• Medical treatment
• Compensation for days not worked per doctor’s orders
• Compensation for permanent physical harm, including pain and suffering •Compensation for loss of normal life
• Repair of damage to your vehicle

Slip and Fall

Every year thousands of people suffer personal injuries caused by slips, falls, and other accidents.
If you have been injured from a slip or fall due to the conditions at a property, store or apartment caused by another person’s negligence, you may be entitled to compensation for your damages. Depending on your injuries, you may receive compensation for your pain, suffering, disfigurement, lost wages, loss of normal life, and other damages. However, it is very important that you take the following steps to protect your rights:

Take photo at the scene of the events
• Record the name and phone number of witnesses
• Immediately report the accident to the owner or property manager
• Go to the emergency room to get proper medical treatment
• File a police report or report the incident to the appropriate agency and call our office as soon as possible

In these types of cases, evidence or proof such as photographs of the scene and witnesses are very important to establish the fault of the owners.
If you have been injured as a result of a slip or fall, never admit fault.

Product Liability

Each year, thousands of people are injured by defective products. The law provides the responsibilities or standards that manufacturers of consumer products must meet in order to make safe products. Persons who are injured by unreasonably unsafe products can obtain compensation for their injuries. There are different ways of establishing a defect in a product:

• Defective design
• Defects at the time the product was made
• Defective or no warning labels

In addition to the company that makes the product, there may be other entities or retailers that can be liable for selling, promoting, or distributing a defective product.

A product can be defective because it was negligently designed, or because it contains defective parts such a car tire that explodes or fails when used as indicated, or a product that presents a well-known risk of injury of which the manufacturer is aware and fails to correct the defect. Other examples of these products are: looped corded window blinds which present a strangulation hazard to young children, defective baby cribs, baby seats and toys containing small parts which can be swallowed by children, etc. The list of defective products is much too big to include here.

Workmans' Compensation

Many accidents are caused by defective equipment, inadequate safety regulations, poor management or supervision and the negligence of either the employer or another entity. But their negligence does not matter. So long as the injury was caused by an accident in a work-related activity you are covered by the Illinois Workers Compensation Act and you are eligible to receive compensation.

You are entitled to the following benefits:
• Medical treatment with the doctors of your choice
• Temporary benefits if you are disabled by a doctor’s order
• Compensation for your injuries once you finish medical treatment

Even if you are receiving compensation from your employer for an accident, you can and should file a claim for compensation for your damages with the Workers’ Compensation Commission. Your claim may include other companies that directly or indirectly contributed to the accident.

Animal Bites

Each year thousands of people suffer  injuries caused by unprovoked dog bites.
If you have been injured from a dog bite at a property, store, apartment or public area caused by another person’s negligence, you may be entitled to compensation for your injuries. Depending on your injuries, you may receive compensation for your pain and suffering, disfigurement, lost wages, medical expenses, loss of normal life, and other damages. However, it is very important that you take the following steps to protect your rights:

Take photo at the scene of events
• Record the name and phone number of witnesses
• Immediately report the accident to the owner or property manager
• Go to the emergency room to get proper medical treatment
• File a police report or report the incident to the appropriate agency
• Call our office as soon as possible

In these types of cases, evidence or proof such as photographs of the scene and witnesses are very important to establish the fault of others.

Bicycle Accidents

Bicycling is more popular than ever, thanks to our desire to seek fitness-related activities and the cities’ expansion of bicycle trails and bicycle paths on city streets in Chicago. As the popularity of the sport continues to grow, bicycle riders need to remember that their safety is not guaranteed as long as they share the road with cars and trucks. Despite the fact that more laws and considerations are given to protecting bicyclists on the road, they are still extremely susceptible to injury compared to the drivers of motor vehicles on the road.

At Pilsen Law Center, our bicycle accident lawyers are prepared to give strong, powerful representation to those with bike injury claims, including cases involving the following circumstances:

  • Struck by a car, truck, bus, taxi, or other vehicle

  • Doored by a car or Chicago Taxi

  • Injured as a result of a pot hole, street plate, man hole cover, or other street hardware defects

  • Injured as a result of blocked or obstructed bicycle lane

  • Injured while working as a bicycle courier

  • Injured while working as a delivery person

  • Injured while visiting Chicago and involved in a crash

  • Any other bicycle or cycle related accident, crash, or injury

Many bicyclists are seriously injured because of the carelessness of other drivers on the road who fail to pay attention or drive recklessly. Although there is very little reliable data on the exact percentages of who is more often at fault, most information points to motor vehicles being at fault at least 50% of the time. In some cases, there might be more than one individual contributing to the accident, making figuring out who is financially responsible even more opaque. Clearly, when cars or different sorts of vehicles hit bicyclists, there is little room for forgiveness and most bicyclists hit by motor vehicles sustain serious or fatal injuries.

Medical Malpractrice

Each year, thousands of lives are devastated nationwide by medical errors. This type of malpractice occurs when a hospital or doctor does not follow the standard of care that all other doctors and hospitals follow when providing medical care to a patient and the patient suffers serious and permanent injuries.

Victims of medical malpractices are often confronted with the harsh reality of disability and loss of financial support due to their inability to work especially if the damages are catastrophic, as it is usually the case in birth injury cases and other victims of medical malpractice.

General signs of medical malpractice:

• Complications that are not part of the medical treatment or procedure
• Wrong diagnosis
• Delay in diagnosis and medical treatment
• Lack of medical treatment required for your condition
• The procedures for treating your symptoms or condition were not followed
• The wrong medication was prescribed
• Delivery complications

Premises Liability

Under Illinois State law, it is the duty of the owner of a property to keep the property in a reasonably safe condition. The failure to do so, may entitle a person who suffers injury as a result of the owner’s carelessness, to hold the owner responsible for medical expenses, pain and suffering, lost wages and other injuries. Each year, the Chicagoland area is the site of numerous accidents caused by the negligence of property managers and owners.

Our premises liability attorneys are prepared to give strong, powerful representation to those inured by negligent property owners or managers, including cases involving the following circumstances:

  • Hotel swimming pool injuries, including drowning

  • Slip and fall and trip and fall accidents

  • Sexual batteries by security officers or business personnel

  • Insufficient security lighting and cameras in parking garages and ramps

  • Injuries suffered in assaults by patrons of theme parks or bars

  • Dog bite attacks

  • Sexual battery as a result of lack of security or lighting

  • Violence as a result of lack of security or lighting

  • Robbery as a result of lack of security or lighting

  • Negligent security

  • Elevator Accidents

  • Falling merchandise

  • Injury resulting from the negligent hiring, supervision or maintaining of business, hotel or theme park employees

Businesses and property owners have an obligation to provide a safe environment to their customers and other individuals on their premises. An innocent patron or customer should not be subjected to known, or latent hazardous conditions. The result of a property owner or business’ negligence can result in their customers suffering personal injury, an assault or even wrongful death.
